We handle two types of cases for the LGBT community. Discrimination in the workplace and medical malpractice. Discrimination is one of the largest issues we see in our community and by far one of the most troubling.
The Supreme Court found on June 15, 2020, that employers can not fire an LGBT employee for simply being gay, lesbian, or transexual. This decision made workplace discrimination based on sexual orientation or gender identity illegal in all 50 states.
Dyer, Garofalo, Mann, & Schultz has been an outspoken supporter of LGBTQA+ rights since its founding. Supporting our community and extending legal protections for everyone has always been our mission. However, it’s more than just something we say. Our family, our friends, and many of our employees make up a part of our local LGBT community. That’s why we as a firm have been working to support and foster our community. For instance, we sponsor PFlag, the Dayton Pride Parade, and are a part of Equality Ohio’s Legal Network.
The LGBT community sees a rate of 1 in 5 adults avoiding hospitals due to discrimination they faced in the past. Medical malpractice is never right and when a medical professional treats you improperly due to your gender identity or sexual orientation, you have rights. However, many states still have few rights for the community for health issues. For example, in the case of HIV, your medical records become very public in a hospital with no right to seek a HIPPA violation. In some states, like Ohio, there can even be jail time for not disclosing HIV status.

When you see discrimination at work, keep documentation. This means keeping things such as:
- Discriminatory Emails
- Phone Calls
- and Records of Witnesses
If you are fired try to get your employer to say or write the reason why you are being fired.
Communicating with HR and can also serve as a form of documentation. Not only could this step resolve your issue but it proves you attempted to resolve it peacefully before pursuing a lawsuit. We recommend:
- Sending email correspondence
- Keeping records of attempts to fix the issue
